California PUC Finalizing Free Cell Phone Service for the Poor






As noted by KGO, the California Public Utilities Commission (CPUC) intends to approve a free lifeline cell phone plan that benefits California‘s poor and homeless residents. Funding for initial setup will come from the federal government.


What are the initial details of the plan?






Qualifying Californians pay an initial $ 20 fee to sign up for a monthly cell coverage plan. It offers 250 free minutes as well as 250 free text messages. From then on, the minutes and message count refill every month as long as the participant qualifies for the program. Assured Wireless — the name of the plan devised by Virgin Mobile, KERN Radio notes — has proposed this coverage to the CPUC.


Unlike the landline lifeline service, which only reduces a phone bill, this cell phone service is actually free of charge for participants. The company notes that plan participants can pay extra for international calling and for the purchase of additional minutes. The phone is free and network service is provided by Sprint. It is not known at this time if paying cell phone service customers will be charged a surcharge or fee to fund the program.


Who benefits from the free cell phone service?


The Coalition on Homelessness notes that those living on the streets will see an immediate benefit. “It’s so huge if you’re living outside you can dial 9-1-1 in the middle of the night; if you need to get in touch with your loved ones, you have a phone, if you’re trying to get in touch with a potential employer,” the Coalition on Homelessness’ Jennifer Friedenbach explained. Low-income wage earners, too, benefit since they no longer have to take money from other budget line items to afford a cell phone.


What is the wage income maximum for a qualifying program participant?


Participants cannot earn more than about $ 15,000 per year to qualify for the free cell phone program.


Is this type of program new?


This is not a new program. There are already 36 states that offer cell phone lifeline programs. The California PUC has thus far been unwilling to approve the program for the State of California.


Why does California need free cell phone service in the first place?


Although the State of California does participate in the federal lifeline landline service via local phone service providers, the number of landlines in service has decreased by 43 percent since 2000. On the flipside, the number of cell phones in use has increased by 123 percent.


What do critics say?


As noted by KERN, there is a question of taxpayer and cell phone customer cost. In other states, Sprint contributes to the program. It then has the option of charging its paying customers a fee that funds the program.


What do proponents say?


As noted by 4-Traders, Assurance Wireless has crunched the numbers for the entire nation and purports, “If all 28.5 million adults eligible for Lifeline Assistance were to take advantage of the program and earn at the same rate and level as [the study] sample, it would result in $ 3.7 billion in fresh income for the poor and near poor.”


What happens next?


As noted by the San Francisco Chronicle, the CPUC has already approved the Golden State’s participation in the program. It now needs to work out the details of Assurance Wireless’ promotional programs to advertise the free cell phone service. Program finalization is tentatively set for two weeks from now.

LA prosecutors seek to violate Lohan's probation


LOS ANGELES (AP) — Los Angeles prosecutors on Tuesday asked a judge to revoke Lindsay Lohan's probation and schedule a hearing that could lead to the actress' return to jail.


The filing came one day before Lohan is scheduled to be arraigned Wednesday on three misdemeanor charges filed last month related to a June car crash.


Lohan will not need to be present for Wednesday's arraignment on charges she lied to Santa Monica police, was driving recklessly and obstructed an officer from performing duties related to the crash investigation. She remains on probation for a 2011 necklace theft case and could be sentenced to 245 days in jail if a judge determines her conduct was a probation violation.


Her attorney Shawn Holley did not immediately return an email seeking comment.


City attorney's spokesman Frank Mateljan said any probation violation proceedings are likely to be heard after the Santa Monica case. Prosecutors allege Lohan lied about being a passenger in her Porsche when it crashed on Pacific Coast Highway on the way to a film shoot.


The "Liz and Dick" star was released from supervised probation in March after completing several months of court appearances and morgue cleanup duty.


Lohan has yet to be booked on the new charges and a judge on Wednesday will likely set bail and the terms of her release.

Rate of Childhood Obesity Falls in Several Cities

PHILADELPHIA — After decades of rising childhood obesity rates, several American cities are reporting their first declines.




The trend has emerged in big cities like New York and Los Angeles, as well as smaller places like Anchorage, Alaska, and Kearney, Neb. The state of Mississippi has also registered a drop, but only among white students.


“It’s been nothing but bad news for 30 years, so the fact that we have any good news is a big story,” said Dr. Thomas Farley, the health commissioner in New York City, which reported a 5.5 percent decline in the number of obese schoolchildren from 2007 to 2011.


The drops are small, just 5 percent here in Philadelphia and 3 percent in Los Angeles. But experts say they are significant because they offer the first indication that the obesity epidemic, one of the nation’s most intractable health problems, may actually be reversing course.


The first dips — noted in a September report by the Robert Wood Johnson Foundation — were so surprising that some researchers did not believe them.


Deanna M. Hoelscher, a researcher at the University of Texas, who in 2010 recorded one of the earliest declines — among mostly poor Hispanic fourth graders in the El Paso area — did a double-take. “We reran the numbers a couple of times,” she said. “I kept saying, ‘Will you please check that again for me?’ ”


Researchers say they are not sure what is behind the declines. They may be an early sign of a national shift that is visible only in cities that routinely measure the height and weight of schoolchildren. The decline in Los Angeles, for instance, was for fifth, seventh and ninth graders — the grades that are measured each year — between 2005 and 2010. Nor is it clear whether the drops have more to do with fewer obese children entering school or currently enrolled children losing weight. But researchers note that declines occurred in cities that have had obesity reduction policies in place for a number of years.


Though obesity is now part of the national conversation, with aggressive advertising campaigns in major cities and a push by Michelle Obama, many scientists doubt that anti-obesity programs actually work. Individual efforts like one-time exercise programs have rarely produced results. Researchers say that it will take a broad set of policies applied systematically to effectively reverse the trend, a conclusion underscored by an Institute of Medicine report released in May.


Philadelphia has undertaken a broad assault on childhood obesity for years. Sugary drinks like sweetened iced tea, fruit punch and sports drinks started to disappear from school vending machines in 2004. A year later, new snack guidelines set calorie and fat limits, which reduced the size of snack foods like potato chips to single servings. By 2009, deep fryers were gone from cafeterias and whole milk had been replaced by one percent and skim.


Change has been slow. Schools made money on sugary drinks, and some set up rogue drink machines that had to be hunted down. Deep fat fryers, favored by school administrators who did not want to lose popular items like French fries, were unplugged only after Wayne T. Grasela, the head of food services for the school district, stopped buying oil to fill them.


But the message seems to be getting through, even if acting on it is daunting. Josh Monserrat, an eighth grader at John Welsh Elementary, uses words like “carbs,” and “portion size.” He is part of a student group that promotes healthy eating. He has even dressed as an orange to try to get other children to eat better. Still, he struggles with his own weight. He is 5-foot-3 but weighed nearly 200 pounds at his last doctor’s visit.


“I was thinking, ‘Wow, I’m obese for my age,’ ” said Josh, who is 13. “I set a goal for myself to lose 50 pounds.”


Nationally, about 17 percent of children under 20 are obese, or about 12.5 million people, according to the Centers for Disease Control and Prevention, which defines childhood obesity as a body mass index at or above the 95th percentile for children of the same age and sex. That rate, which has tripled since 1980, has leveled off in recent years but has remained at historical highs, and public health experts warn that it could bring long-term health risks.


Obese children are more likely to be obese as adults, creating a higher risk of heart disease and stroke. The American Cancer Society says that being overweight or obese is the culprit in one of seven cancer deaths. Diabetes in children is up by a fifth since 2000, according to federal data.


“I’m deeply worried about it,” said Francis S. Collins, the director of the National Institutes of Health, who added that obesity is “almost certain to result in a serious downturn in longevity based on the risks people are taking on.”

Michigan puts limits on unions









NEW YORK —- Labor relations in the Midwest reached a new level of acrimony as Michigan Gov. Rick Snyder abruptly signed legislation placing limits on unions, setting up a bitter political battle that could resonate nationwide.


It's a stunning development for a blue state that's been known as a place friendly to labor, where autoworkers and their families from Detroit to Saginaw have benefited from generous union contracts. An estimated 15,000 workers descended on the state Capitol in Lansing on Tuesday to protest against the bills, scuffling at times with police and conservatives who also set up shop at the Capitol.


House members passed two bills that would make Michigan a "right to work" state, essentially prohibiting union security agreements, which make union membership or fees a condition of employment. The bills, which covered private sector and public sector employees, had passed the state Senate last week.





Snyder, a Republican, signed both bills in private Tuesday afternoon, hailing the legislation as a victory for Michigan workers and a way to bring more jobs to the state.


"This is a major day in Michigan's history," he said at a news conference. "This is an opportunity for unions to step up and say how they can provide the best value to workers in our state."


The legislation comes as workplace tensions grow across the country.


While employees making low wages at companies such as Wal-Mart Stores Inc. and McDonald's Corp. are protesting to demand higher wages, businesses are increasing the number of lockouts they impose on workers. And in the last two years, union supporters have converged on state capitols in Wisconsin, Indiana and Ohio to oppose bills that restricted their power.


Now, labor groups from around the country are watching what happens in Michigan, where labor groups have vowed to overturn the law and vote Snyder out of office by 2014. If Michigan, which voted for President Obama over native son Mitt Romney by 8 percentage points, becomes a right-to-work state permanently, others could follow suit.


"Michigan could prove defining," said Harley Shaiken, a labor expert at UC Berkeley. "What happens here, given the role of unions historically in Michigan, and the larger political implications of right-to-work, could mean a lot."


The bills came as a surprise to many in labor, especially after recent victories at the ballot box. Gov. Snyder had initially said he was not interested in pursuing right-to-work laws, because they affected a relatively small number of Michiganders.


But he said that Proposal 2, a labor-backed referendum on the November ballot, "triggered the dialogue" about labor issues and led him to ultimately support anti-union legislation. The proposal would have enshrined collective bargaining rights in the state's constitution, but it was rejected by voters by a large margin.


"I asked labor leaders not to move forward with the ballot proposal because I knew it could trigger a discussion that could lead to right-to-work being a divisive issue," he said. "Unfortunately, they moved forward, it became divisive, and it was time to step up and take a leadership position."


It's unlikely the Legislature would have had enough votes to pass the bills in January, when the Legislature will still be in Republican control but more moderate, said Roland Zullo, a research scientist at the University of Michigan's Institute for Labor and Industrial Relations. The legislative approval, and Snyder's backing, signal that the partisan discord paralyzing the federal government is present on a local level too.


"There's retribution on many levels here," Zullo said. "It would have been easy for the current political party to walk away and say it is done, but instead, during this lame duck session when they feel they have the votes, they're pushing through a right-to-work law, allowing no debates."


Even before the legislation passed Tuesday, labor leaders were brainstorming ways to reverse the bills. The right-to-work legislation is attached to appropriations bills, so it can't simply be reversed in a referendum. But it could be reversed in a citizen's initiative in 2014, the same year that Snyder would be running for reelection.


"While it was disappointing that Snyder rammed this divisive 'tea party' legislation through we are considering all options that are on the table," said Eddie Vale, a spokesman for the labor-funded Workers' Voice. "Whether it is the available ballot initiative option, or Snyder's reelection itself, he will strongly hear the voices of Michiganders in 2014."


Unions have had mixed results overturning the slate of anti-labor laws that have been passed in the last two years. In Wisconsin, where Gov. Scott Walker signed a bill limiting collective bargaining for public sector employees, the law is still being challenged in various courts. An effort to recall Walker failed.


Labor had more success in Ohio, where Gov. John Kasich signed a bill in early 2011 that restricted collective bargaining rights for public employees. Unions were able to repeal the bill through a referendum in November 2011.


Anger against Kasich and Ohio Republicans may have helped President Obama win in Ohio in November.


Unions are popular in some parts of Michigan, where they had guaranteed pensions, benefits and high wages for decades in the auto industry. Although they were blamed by some for bankrupting the auto industry during the recession, they have regained trust by agreeing to a number of concessions with the Big Three automakers, said Kristin Dziczek, director of the labor and industry group for the Center for Automotive Research.


"A lot of people are currently benefiting from the United Auto Workers' bargaining, or have in the past," Dziczek said.


Conservative groups hailed the passage of the bills as an economic boon for Michigan, which was plagued by some of the highest unemployment rates in the nation during the recession.


"In addition to greater freedom for Michigan's workers, the right-to-work law will provide significant economic benefits for the state's workers and small businesses," Mark Mix, president of the National Right to Work Committee, said in a statement.


Michigan probably won't see the repercussions of the bills for a few years. That's because the right-to-work legislation only goes into effect when unions renegotiate contracts with management. For many autoworkers, that won't happen until 2015.

Take 10 steps west and you're staring at a funky building that looks as if it's been covered with moon rocks. At Moon Juice, $3.50 will buy you just a two-ounce shot of a detoxifying acid mineral complex called "Liquid Light" and a bit of change for the tip jar. If you want a full glass of organic cold-pressed "Gracious Greens" juice, it'll cost you $12.





To pay, hand your money to young workers who give each other massages behind the counter while serving their customers.

Urban planners say Rose Avenue is unlikely to become the next Abbott Kinney — the nearby boulevard recently dubbed "The Coolest Block in America" by GQ magazine — but the breakneck pace of change along these once shabby blocks connecting Lincoln Boulevard to Pacific Avenue suggests that the down-and-out bohemian days of this countercultural beach neighborhood are numbered.


If Rose Avenue could turn white-hot overnight, other Venice streets could soon follow.


"The tipping point," said former City Councilwoman Ruth Galanter, "has been tipped."

When he created his "Venice-of-America" in 1905, Abbott Kinney envisioned a showcase of art and culture. Instead, said Betsy Goldman, Venice Historical Society co-founder, the public insisted on a "honky-tonk" carnival atmosphere with gondola excursions and camel rides.


For decades that carnival vibe was reincarnated: In the 1950s and '60s, Goldman said, Venice served as a gathering place for hippies, homeless people and beatnik intellectuals and musicians like Jim Morrison. Beach life and an atmosphere of permissiveness drew motorcycle gang members and drug addicts as well. Pawn shops and liquor stores sprouted.


Venice gained a reputation as a rough outpost among beach communities. Occasional violence and the presence of homeless people deterred business owners for years. By the early 1990s, police say, area crime had hit an all-time high.


But Rose Avenue rents were cheap. A few retailers thought they might draw shoppers from Santa Monica. So Alan Schniderman opened his DNA Clothing store on the block in the 1980s.


People slept in a nearby parking lot, he said. Cockroaches scuttled across the asphalt. Schniderman recalls a red curtain that marked a peep show just off Rose Avenue on Main Street.


The rehabilitation of the Venice Canals in the early 1990s made the surrounding property in the south part of the neighborhood more attractive but largely left Rose Avenue and adjoining Oakwood behind.


Schniderman was shocked when a tiny wine shop opened two blocks down in 2006.


"When they opened," he said, "I thought, 'They're never going to make it.'"

"Hey, hey, good to see ya!" Oscar Hermosillo shouted over the chatter, clapping a friend on the back. The owner of Venice Beach Wines couldn't even walk out the back of his wine bar one recent Friday night. The 500-square-foot space was packed tighter than standing room only.


When Hermosillo got some wiggle room, he greeted three more people on the way to the door and then stopped to chat with two men outside. A few steps away, a woman bundled in layers of shirts and jackets emerged from Rose Market with a beer and retrieved a shopping cart filled with her belongings. Two couples wrapped in peacoats and sweater vests strutted past her in the other direction.

'Skyfall' launches back to top spot with $10.8M

NBCUniversal bolsters Telemundo as U.S. Latino market grows









Telemundo has long been like a remote Caribbean island, cut off from its sprawling media homeland.


NBCUniversal acquired the Spanish-language television network a decade ago for $2 billion but became discouraged by its seemingly limited prospects. But Comcast Corp.'s takeover of NBCUniversal last year may be building Telemundo a bridge to the mainland.


"Telemundo now has the full support of Comcast and NBCUniversal," said Emilio Romano, a former Mexican airline chief executive who was hired a year ago to run Telemundo. "For them, Telemundo is clearly a diamond in the rough."

The Miami-based network, which began in 1954 as a single Puerto Rico TV station, had long been viewed as an "East Coast" outlet infused with Caribbean flavor — not the right ingredients for the majority of U.S. Latinos, two-thirds of whom are from Mexico or are of Mexican descent.


Appealing to viewers with Central American heritage has become central to NBCUniversal's campaign to grow Telemundo. But there's a hitch: Telemundo's rival, Univision Communications, has a lock on Mexico's top-rated prime-time soap operas, plus contracts with top Mexican actors and the rights to some of the most popular Mexican soccer teams — making Univision the network of choice for most Mexican immigrants.


So Telemundo has had to shell out tens of millions of dollars to produce original programming to compete in the increasingly crowded field of Spanish-language television.


"They are a hungry No. 2," said Carmen Baez, president of Latin America operations for advertising behemoth Omnicom Group. "It's like that old Avis rental-car slogan: 'We try harder.'"


Since Comcast took majority control of NBCUniversal in January 2011, it has installed new management at Telemundo and increased the operating budget. Last year Comcast agreed to spend about $600 million for the rights to broadcast the FIFA World Cup soccer tournaments in 2015 through 2022 — nearly double the amount that Univision currently pays.


The company increased Telemundo's annual programming budget nearly 20% and steered more resources to local Telemundo stations, including KVEA-TV Channel 52 in Los Angeles — the nation's largest Spanish-language media market. KVEA has spent several million dollars improving its equipment, strengthening its broadcast antenna and converting to a high-definition signal. Last year it added a morning newscast, "Buenos Dias L.A.," and this year a Sunday local affairs program, "Enfoque Los Angeles."


"It's a 360-degree programming strategy built around cultural relevance," said Lauren Zalaznick, who oversees Telemundo as NBCUniversal's chairman of entertainment and digital networks.

For example, because many Latino families watch television together, Telemundo licensed films from Walt Disney Co.'s Pixar Animation Studios, creator of such blockbusters as "Toy Story" and "Cars," to build a Sunday night movie block. Telemundo has slowly bolstered its daytime schedule, sending its TV judge, Ana Maria Polo — who's been dubbed the "Latino Judge Judy" — on a road trip to Los Angeles and broadcasting more news from Mexico.


The company also has paid more attention to Mun2, its bilingual youth-oriented cable channel with a strong presence in L.A. This week the channel was dealt a devastating blow with the unexpected death of its reality show superstar, Jenni Rivera, in a plane crash in northern Mexico.


Telemundo draws an average of 1.2 million viewers in prime time, an increase of 5% over 2011 and 18% more than in 2010, according to ratings firm Nielsen. Univision's ratings have held steady but its second broadcast network, TeleFutura, is down 5% this year.


"Telemundo is a high-growth asset," Zalaznick said. "When we looked at the Hispanic American audience, we found that immigration growth in the U.S. had slowed considerably. We realized that we were looking at an existing pie, and if we wanted to grow, then we were going to have to take share away from our competitors."


The company's strategy is starting to pay off, said Lia Silkworth, co-managing director of the ad firm Tapestry, which specializes in Latin media.


"They are making a cognizant effort to be more balanced in who they put on camera — their music celebrities, actor choices and the story lines. It's a matter of being relevant to the largest possible audience," Silkworth said. "They are trying to be true to their audience, and having the audience see themselves in what they see depicted on the TV screen."


Silkworth and Omnicom's Baez said Telemundo stands out for advertisers because it develops its own dramas and produces them in the U.S. instead of importing them from Mexico. Marketers are able to insert their brands and products into the story lines, a practice called "product placement." For example, in the show "Corazon Valiente," a character's wife becomes jealous when he receives a phone call from another woman. But the man explains the caller is their State Farm insurance agent.


Consulting firm SNL Kagan estimated that Telemundo will generate about $340 million in revenue this year, an increase of 6.5% over 2011. The firm expects operating income to reach $62 million, an increase of 8.4%.


NBCUniversal's campaign to bolster Telemundo comes as other major media companies join the race to reach the estimated 50 million Latinos living in the U.S. Disney's ABC, Rupert Murdoch's News Corp. and Time Warner Inc.'s CNN have been gearing up new TV programming services to target Latinos.


Integrating Telemundo's operations within NBC long has been a challenge, but observers say they are seeing greater signs of cooperation. For example, Telemundo set up its operations near the NBC News anchor desk at Rockefeller Center in New York last month for its election night coverage. The network saw 30% higher audience turnout than in 2008.


Next year Telemundo plans to introduce a children's version of NBC's "The Voice," called "La Voz: Niños."


The network also has been beefing up its sports coverage. Although Telemundo's experiment to broadcast an NFL football game on Thanksgiving night was a turkey, last summer the network aired more than 170 hours of coverage from the London Olympics — a 20% increase compared with the 2008 Beijing Olympics — which produced strong ratings, particularly for soccer.


"You cannot underestimate the power of a strategic focus," Zalaznick said. "Our programming will resonate if it incorporates family values and themes such as testing of one's soul by pursuing the American dream, and achieving a better legacy for your kids than the one that you inherited."

Cal State San Bernardino police kill student during struggle









Three Cal State San Bernardino police officers struggled with an unarmed graduate student for about seven minutes Saturday evening at an off-campus housing complex before growing fearful for their own safety and fatally shooting him, authorities said.


Bartholomew Williams, 38, exhibited "super-human-type strength" during the tussle, using the officers' pepper spray against them and grabbing one of their batons, said a spokesman for the San Bernardino Police Department, which is investigating the shooting.


Two of the officers fired at Williams after he wrestled the third officer to the ground and began kicking him in the head and torso, said spokesman Lt. Paul Williams. None of the officers was carrying a Taser.





"This became a prolonged, violent struggle," the spokesman said.


One of the officers was hospitalized after the incident and treated for minor injuries, he said.


The shooting occurred about 6:30 p.m. at University Village, a student housing complex on Northpark Boulevard where Bartholomew Williams lived.


The officers were responding to a report from a dorm staff member regarding Williams' alleged irrational behavior. Upon making contact with Williams in the hallway, the officers determined that he was a threat to himself and others and tried to arrest him. But they were unable to handcuff him.


The police spokesman described Williams as a muscular male who weighed more than 200 pounds. Family members told police he had suffered from a mental disorder and had stopped taking his medication, the spokesman said.


School officials said that Williams was pursuing a master's degree in educational instructional technology, and that he had first enrolled in summer 2011.


"This is a tragic day for the Cal State San Bernardino community," university President Tomás Morales said in a statement. "Words cannot express how truly saddened we are at this time. We extend our deepest sympathies to his family, and our thoughts and prayers go out to all who knew him."


Morales also said the officers "performed their best to assure the safety of the campus community."


But civil rights activists called on the San Bernardino County district attorney's office to conduct an immediate investigation into the shooting.


"A fast-track, transparent probe by the D.A.'s office is the only way to ensure that all the facts in the tragedy are known and justice is done," said Earl Ofari Hutchinson, president of the Los Angeles Urban Policy Roundtable.

Apple, Samsung face off in court again






SAN JOSE (Reuters) – Apple Inc and Samsung Electronics squared off again in court on Thursday, as the iPhone maker prepares to convince a U.S. district judge to ban sales of a number of the Korean company’s devices and defend a $ 1.05 billion jury award.


Apple scored a sweeping legal victory in August at the conclusion of its landmark case against its arch-foe, when a U.S. jury found Samsung had copied critical features of the iPhone and iPad and awarded it $ 1.05 billion in damages.






U.S. District Judge Lucy Koh is expected to address a range of issues at the hearing, which began Thursday afternoon. They include setting aside any of the jury’s findings on liability, juror misconduct, and the requested injunction.


Twenty four of Samsung’s smartphones were found to have infringed on Apple’s patents, while two of Samsung’s tablets were cleared of similar allegations.


Koh began by questioning the basis for some of the damages awarded by the jury, putting Apple’s lawyers on the defensive.


“I don’t see how you can evaluate the aggregate verdict without looking at the pieces,” Koh said.


Samsung’s lawyers argued the ruling against it should be “reverse engineered” to be sure the $ 1.05 billion was legally arrived at by the jury, while Apple said the ruling should stand as is.


FIERCEST RIVAL


Samsung is Apple’s fiercest global business rival, and their battle for consumers’ allegiance is shaping the landscape of the smartphone and tablet industry, and has claimed several high-profile victims including Nokia.


While most of the devices facing injunction are older and, in some cases, out of the market, such injunctions have been key for companies trying to increase their leverage in courtroom patent fights.


In October, a U.S. appeals court overturned a pretrial sales ban against Samsung’s Galaxy Nexus smartphone, dealing a setback to Apple’s battle against Google Inc’s increasingly popular mobile software.


Some analysts say Apple’s willingness to license patents to HTC could convince Koh it does not need the injunction, as the two companies could arrive at a licensing deal.


Apple is also attempting to add more than $ 500 million to the $ 1 billion judgment because the jury found Samsung willfully infringed on its patents.


Samsung, for its part, wants the verdict overturned, saying the foreman of the jury in the trial did not disclose that he was once embroiled in litigation with Seagate Technology, a company that Samsung invested in.


Both Apple and Samsung have filed separate lawsuits covering newer products, including the Samsung Galaxy Note II. That case is pending in U.S. District Court in San Jose and is set for trial in 2014.
